General Terms and Conditions for Accommodation Services
1. Application of the terms and formation of the agreement
These terms apply to the accommodation service provided by Erikois Apartments (PKM-Kiinteistöt Oy, hereinafter the Service Provider) to its business customers (hereinafter the Customer). The terms also apply when a separate accommodation service agreement is concluded.
The agreement is formed when the Customer accepts the offer or booking confirmation or pays the accommodation fee. If the accommodation service agreement, offer or booking confirmation states something that differs from these terms, it prevails.
The terms are available at erikois.fi/terms and are referred to in the offer and booking confirmation. The Service Provider may update the terms. A booking is governed by the terms in force at the time the agreement was formed.
2. Service contents
Unless otherwise stated in the offer, the accommodation fee includes furniture, kitchen equipment and tableware, bed linen, internet, electricity, water and heating. Parking and other additional services are agreed separately in the offer.
This is a temporary accommodation service, not a residential lease. The accommodated persons do not acquire tenant status in the accommodation premises, and the premises are not used for permanent residence.
3. Price and payment
The accommodation fee is determined by the offer or booking confirmation, and the applicable value added tax is added to the prices. Unless otherwise agreed in the offer, the payment term is 14 days net.
The accommodation fee is invoiced in advance and must in all cases be paid before the accommodation begins. Stays longer than one month are invoiced monthly, and the fee for each month of accommodation must be paid before that month begins (for example, the fee for July by 30 June at the latest).
Late payments accrue penalty interest in accordance with the Finnish Interest Act, together with collection costs and the standard compensation under the Finnish Act on Debt Collection.
The Service Provider may require a security deposit or advance payment from the Customer.
4. Arrival and departure
Arrival and departure times and the handover of keys are agreed on a case-by-case basis.
The Customer must notify the Service Provider of any defects found in the accommodation premises immediately and no later than two days after arrival. Otherwise the Customer is deemed to have accepted the premises in their condition at handover.
Extension of the accommodation period is agreed separately. If the accommodated persons do not vacate the premises on the agreed departure date, the Customer is charged the accommodation fee for each additional day together with the costs arising from the overstay.
5. Cancellations and changes
A confirmed booking cannot be cancelled or changed. A cancellation or change may, however, be separately agreed with the Service Provider.
The accommodation fee is payable for the entire agreed accommodation period regardless of whether the premises are used. This also applies to early departure, no-show and a reduction in the number of persons. A change, delay or interruption of the Customer's project does not entitle the Customer to cancel or change the booking.
6. Use of the accommodation premises
The accommodation premises must be used with due care, and no more than the agreed number of persons may stay in them. The Customer must provide the Service Provider with the names of the accommodated persons before arrival and notify any changes without delay. The Customer is responsible for ensuring that the accommodated persons provide the information required for the statutory guest registration (matkustajailmoitus).
The accommodated persons must comply with the house rules and quiet hours of the housing company and must not disturb the neighbours. Repeated disturbance constitutes a material breach of the agreement.
The premises may not be assigned to a third party or used for any purpose other than accommodating the Customer's own accommodated persons.
Smoking is prohibited indoors and on balconies, and pets are not allowed. Odour removal and special cleaning resulting from a breach of this prohibition are invoiced to the Customer according to actual costs. No alterations or repair work may be carried out in the premises without the Service Provider's consent.
The Service Provider has the right to access the premises for inspection, maintenance and repairs with prior notice, and in an emergency without prior notice.
The Customer must notify the Service Provider without delay of any defects or damage detected. The Customer is liable for any aggravation of the damage caused by a delayed notification.
Electricity and water are included in the price according to normal residential use. Normal use does not include, for example, charging vehicles, work machinery or tool batteries, or other exceptionally high consumption. Costs arising from such use are invoiced to the Customer according to actual consumption.
7. Keys and cleaning
Unless otherwise agreed regarding cleaning, the accommodation premises shall be returned cleaned. If the premises have not been cleaned or if belongings or waste are left behind, the cleaning and removal are invoiced to the Customer according to actual costs.
Costs arising from lost or unreturned keys are invoiced to the Customer according to actual costs.
8. Customer's liability
The Customer is responsible for the conduct of the accommodated persons and liable for all damage exceeding normal wear and tear. The Customer must have valid liability insurance.
9. Service Provider's liability
The Service Provider is not liable for indirect or consequential damages, such as business interruption or actions of third parties. The Service Provider's liability is limited to direct damages and shall not exceed the accommodation fee paid by the Customer for the premises in question for the calendar month in which the damage occurred.
The Service Provider is not liable for the property of the accommodated persons, including its theft, loss or damage.
The Service Provider repairs defects in the premises within a reasonable time. Minor defects do not entitle the Customer to a price reduction or compensation.
If the accommodation premises are unavailable due to force majeure or another reason beyond the Service Provider's control, the Service Provider may offer equivalent accommodation premises instead. If equivalent premises cannot be offered, the Service Provider may cancel the booking. In that case the unused accommodation period is not charged, and the Customer is not entitled to any other refund or compensation.
10. Early termination of the accommodation
The Service Provider has the right to suspend the service and terminate the accommodation with immediate effect if payment of the accommodation fee is delayed by more than 10 days from the due date or if these terms are materially breached. The Customer is notified of the termination in writing; email is sufficient.
The Customer's payment obligation remains in force for the entire agreed accommodation period even if the accommodation is terminated due to the Customer's breach. Keys must be returned immediately. The Service Provider may dispose of any belongings left in the premises at the Customer's expense.
11. Notices and contact persons
Notices between the parties are given by email. Each party appoints a contact person for matters concerning the accommodation.
12. Personal data
The Service Provider processes the personal data of the accommodated persons in order to provide the accommodation and to fulfil its statutory obligations, such as guest registration. See the privacy policy.
13. Governing law and disputes
These terms and the accommodation service are governed by the laws of Finland. Disputes shall primarily be settled through negotiation. Failing that, they shall be settled in the District Court of Helsinki.
